Judicial Management & Corporate Rescue
Legal protection, legal moratorium, and independent restructuring management under the Companies Act 2016
Judicial Management is a statutory corporate rescue mechanism introduced under Division 8 of Part III of the Companies Act 2016 designed to give financially distressed companies a second chance. Upon filing an application with the High Court, an automatic moratorium is placed on all legal proceedings, execution actions, and winding-up petitions against the company. An independent Judicial Manager, who must be a licensed Approved Liquidator, is appointed to assume management control and formulate a comprehensive proposal to rehabilitate the company or achieve a better financial recovery for creditors than an immediate liquidation.
Who is this for?
Insolvent or Near-Insolvent Companies with viable core operations that require temporary legal relief from aggressive creditors, statutory demands, or bank foreclosure.
Directors & Board Management seeking an alternative to formal liquidation to preserve enterprise value, protect ongoing commercial contracts, and restructure debt obligations.
Creditors & Financial Institutions looking for a structured, court-supervised turnaround scheme that preserves business value.
