Court Winding Up & Private Approved Liquidator Appointments
High Court insolvency execution, Section 466 statutory demand resolution, and contentious asset recovery in Malaysia.
Court Liquidation (Compulsory Winding Up) occurs when the High Court of Malaya issues a formal Winding Up Order against a company. This is usually initiated by a creditor following an unpaid Section 466 Statutory Demand (for debts exceeding RM50,000) or by shareholders facing irreparable management deadlocks or oppression under the Companies Act 2016.
Private Liquidator vs. Official Receiver
Upon a court order, the Official Receiver (Jabatan Insolvensi Malaysia) is automatically appointed by default. However, creditors or petitioners can apply to appoint a Private Approved Liquidator to ensure faster asset realization, dedicated investigation into missing assets, and proactive dividend distribution.
